The Captain of Market Management Team No. 5 under the Market Management Department of Hung Yen province has issued a Decision to impose an administrative penalty on H.P Production and Trading Company Limited, located in Nghia Hiep, Yen My, Hung Yen, with a fine of 27,600,000 for the act of manufacturing, designing, manufacturing, processing, assembling VND, processing, and packaging goods with signs of infringing on industrial design rights. At the same time, the remedial measure of forcing the destruction of infringing goods is 255 motorbike lights that infringe on industrial design rights that have been granted exclusive design patents.

At the time of inspection, the inspection team discovered that H.P Production and Trading Limited Company was trading 255 motorcycle lights with signs of infringing on industrial design rights that had been granted an exclusive industrial design patent. The inspection team drew up a record to temporarily detain and seal all goods with signs of infringement to continue to coordinate with the authorities to verify and clarify.

The verification results determined that all 255 motorcycle lights that Market Management Team No. 5 temporarily seized from H.P Production and Trading Limited Company were goods manufactured and assembled by the enterprise itself. These goods had designs that "infringed upon the rights to industrial designs currently protected under the exclusive industrial design patent No. 34421 of Dai Phong Production, Trading and Service Limited Company."

A product/part of a product is essentially considered a copy of a protected industrial design if it has a set of external design features that contain all the basic design features of the protected industrial design, differing only in design features that are not easily recognizable or memorable.
